US Judge Mandates Freedom of Abrego Garcia from Immigration Custody

Legal proceedings

A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was detained in federal detention.

In her decision, the judge pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Background of the Case

The court challenge involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in Tennessee.

Terms of Release

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.

This decision marks a notable development in a complicated immigration battle featuring claims of wrongful detention and disputed gang affiliations.
